“Last month, the feds swooped down on a successful Maryland dairy business, South Mountain Creamery, seizing $70,000 in its bank accounts and formally charging its owners, Randy and Karen Sowers, with the offense of bank “structuring.” Based in Middletown, outside Frederick, South Mountain has thrived as a direct-to-consumer seller at farmer’s markets and other food events in Baltimore and elsewhere around the region. That means it does a lot of cash business, which helped get it in trouble. The feds charged last month that Randy Sowers had been arranging bank deposits so as not to put in more than $10,000 at once, a threshold that triggers the requirement to file paperwork with the feds. There was no allegation that Mr. Sowers was engaged in tax evasion or other underlying illegality, aside from seeking to avoid large deposits.

Few among the general public realize it, but splitting up large bank deposits to avoid the need to file federal reports on them constitutes a criminal offense known as “structuring” under something called the Bank Secrecy Act. The idea is that the reporting requirement helps federal investigators detect some instances of drug money laundering and terrorist finance, and that if a pattern of repeated $9,000 deposits were not also banned, the law would be too easily evaded. In fact, the feds instruct banks to report suspicious patterns of sub-threshold deposits, and not to warn customers that they are doing so. When the Supreme Court ruled in 1994 that the law would not support a conviction unless defendants knew the practice was illegal, Congress promptly passed a bill striking out the willfulness requirement.”

That’s right, Dr. Manny, liberty is just a word but soda is forever.

[Emphasis mine] “Personally, I think it’s about time. Despite the fact that I hate government regulating how we behave, this one makes a lot of sense to me. For decades, the sizes of drinks and food have gotten out of proportion.”

What else would “make sense” to you, Dr. Manny? Oh, and what is preventing anyone from buying a few small sodas, combining them into a large cup (recycled before the supposed ban) and drinking more than they would otherwise?

Guess we should ban containers larger than 44 oz, ay there Dr. Manny?

The Great Walter E. Williams Not Optimistic

“Here’s the question for us: Is the U.S. moving in a direction toward or away from the troubled EU nations? It turns out that our national debt, which was 35 percent of GDP during the 1970s, is now 106 percent of GDP, a level not seen since World War II’s 122 percent. That debt, plus our more than $100 trillion in unfunded liabilities, has led Standard & Poor’s to downgrade our credit rating from AAA to AA+, and the agency is keeping the outlook at “negative” as a result of its having little confidence that Congress will take on the politically sensitive job of tackling the same type of entitlement that has turned Europe into a basket case.

I am all too afraid that Benjamin Franklin correctly saw our nation’s destiny when he said, “When the people find that they can vote themselves money, that will herald the end of the republic.”

Medal of Freedom Now Worthless

*Groan*

“President Barack Obama on Tuesday awarded the Presidential Medal of Freedom—which he described as “the highest civilian honor this country can bestow”–on retired Supreme Court Justice John Paul Stevens, who wrote a Supreme Court opinion arguing that a woman was exercising her right to “liberty” when she hired a doctor to kill her child through the procedure known as partial-birth abortion.

“That holding–that the word ‘liberty’ in the Fourteenth Amendment includes a woman’s right to make this difficult and extremely personal decision–makes it impossible for me to understand how a State has any legitimate interest in requiring a doctor to follow any procedure other than the one that he or she reasonably believes will best protect the woman in her exercise of this constitutional liberty,” Justice Stevens wrote in his concurring opinion in Stenberg v. Carhart.”
